{"id":382,"date":"2023-07-17T09:58:00","date_gmt":"2023-07-17T09:58:00","guid":{"rendered":"https:\/\/moore-hungary.eu.moore-global.com\/?p=382"},"modified":"2025-12-08T15:03:00","modified_gmt":"2025-12-08T15:03:00","slug":"options-for-parents-with-extra-childcare","status":"publish","type":"post","link":"https:\/\/www.mooreglobal.hu\/en\/a-szulok-lehetosegei-gyed-extra-igenybevetelevel\/","title":{"rendered":"THE POSSIBILITIES FOR PARENTS TO CLAIM \u201eCHILDCARE EXTRA\u201d"},"content":{"rendered":"<p>In this leaflet, we would like to summarise the factors that parents should consider when applying for childcare allowance and during the period of childcare benefit, so that they can make the right choice from the options offered by the legislation, according to their life situation, future plans and financial situation.<\/p>\n\n\n\n<p><br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Abbreviations and terms used<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>CSED<\/strong>: Infant care allowance&nbsp;<em>(Art. 40-42 of the Eb. tv.)<\/em><\/li>\n\n\n\n<li><strong>GYED<\/strong>: Childcare allowance&nbsp;<em>(Eb. tv. \u00a7 42A. - 42G.)<\/em><\/li>\n\n\n\n<li><strong>GYES<\/strong>: Childcare assistance&nbsp;<em>(Act LXXXIV of 1998 on Family Support, \u00a7 20 - 22)<\/em><\/li>\n\n\n\n<li><strong>Provided by<\/strong>: As a general rule, insured persons are entitled to all social security benefits, including cash benefits in addition to benefits in kind, thus providing an opportunity to alleviate loss of earnings in the event of sickness and maternity.&nbsp;<em>(Tbj. \u00a7 5)<\/em><\/li>\n\n\n\n<li><strong>Eligible for health care services<\/strong>: Uninsured persons (e.g. pensioners, people receiving childcare) can only be entitled to health benefits under social security rules on the basis of social solidarity.&nbsp;<em>(Art. 22 of the Tbj.)<\/em><\/li>\n<\/ul>\n\n\n\n<p><br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is GYED extra?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>The colloquial term GYED extra does not actually refer to a separate benefit, but is the umbrella term for measures to help people with children return to the labour market and to allow them to claim different health insurance benefits at the same time.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Provides the opportunity to.<strong>&nbsp;mothers can return to work from the age of six months, while continuing to receive GYED.<\/strong><\/li>\n\n\n\n<li>It is possible to use the&nbsp;<strong>GYED should be claimed by the father<\/strong>&nbsp;even if you are working, so you can get GYED from the&nbsp;<strong>in addition to your wages&nbsp;<\/strong>you can get.<\/li>\n\n\n\n<li><strong>Multiple benefits paid at the same time<\/strong>: In the case of several children, benefits may be paid separately per child if the benefits are paid for children of different ages. That is, a mother can receive GYED benefits for her older child and CSED benefits for her younger child at the same time.<\/li>\n\n\n\n<li><strong>Iker children<\/strong>&nbsp;in the case of&nbsp;<strong>Duration of entitlement to GYED<\/strong>&nbsp;is extended by 1 year, i.e. from 2 years to&nbsp;<strong>children up to 3 years old<\/strong>&nbsp;the GYED is paid.<\/li>\n\n\n\n<li><strong>For graduate GYED&nbsp;<\/strong>full-time students at a higher education institution may be entitled to so-called \u201egraduate GYED\u201d for their child, if certain eligibility conditions are met (the father can only claim the benefit in exceptional cases).<\/li>\n<\/ul>\n\n\n\n<p>So you do not\/can not claim the GYED extra separately, as there is no such benefit.<\/p>\n\n\n\n<p><br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Apai GYED<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Eligibility, conditions for applying<\/h3>\n\n\n\n<p>The law provides, inter alia, that&nbsp;<strong>insured parent&nbsp;<\/strong>who is entitled to childcare allowance&nbsp;<strong>have been insured for 365 days in the 2 years preceding the birth of the child<\/strong>.&nbsp;<br><strong>Parent<\/strong>&nbsp;of course, just as much the father as the mother&nbsp;<em>(as well as the adoptive parent, the spouse living with the parent, the guardian and the person who wishes to adopt a child living in his\/her own household and who is in the process of doing so)<\/em>.<br><strong>If the father meets the conditions for eligibility,<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>if the mother was entitled to CSED: from the day after the CSED expired,<\/li>\n\n\n\n<li>if the mother was not entitled to CSED: from the 169th day after the birth of the child<\/li>\n<\/ul>\n\n\n\n<p>the father can claim the benefit.<br>At any time while the benefit is being paid, the family can decide that the father will take the GYED started by the mother.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Claim procedure<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>If the mother is not receiving any benefits at the time of claiming<\/strong><br>The father can apply for GYED by filling in the form \u201eApplication for childcare allowance\u201d and sending it to the employer.<\/li>\n\n\n\n<li><strong>If the mother is receiving GYED or GYES at the time of application<\/strong><br>If the mother is in receipt of GYED or GYES benefits at the time of the father's application, the application must be accompanied by&nbsp;<strong>the mother must cancel that care<\/strong>, which will be paid<blockquote>for -GYED&nbsp;<strong>\u201eRequest for waiving childcare allowance\u201d&nbsp;<\/strong>on the form,<\/blockquote><blockquote>for -GYES&nbsp;<strong>\u201eFamily support benefit waiver\u201d&nbsp;<\/strong>on the form.<\/blockquote>The father can apply for GYED at the same time as the waiver.<br>The date of cancellation and the date of claim must be the same on the two documents, as the benefit can be claimed not only from the date of claim but also retroactively.<\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\">\n<li><\/li>\n<\/ol>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Retroactive claim<\/h3>\n\n\n\n<p>If the parents do not have sufficient information about the possibility of the father claiming the benefit, or decide later that the father would still claim the benefit, they can exercise this right retroactively to the period before the date of the claim.<br><strong>You can claim GYED backdated for up to 6 months, but not earlier than the first day on which you become eligible.<\/strong><br><em>For example:<\/em><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><em>The mother was not entitled to CSED benefits and the child turned 169 days old on 01.01.2023. The father found out on 28.03.2023 that he may be eligible for GYED benefits.&nbsp;<strong>\u201eApplication for childcare allowance\u201d<\/strong>&nbsp;form, but in point 3 of the form \u201e01.01.2023.\u201d as the starting date of the application.<\/em><\/li>\n\n\n\n<li><em>The mother was entitled to CSED benefits, which ended on 01.02.2023. Since the mother is receiving a very low amount of GYED, on 30.09.2023, it is decided that the father will still claim GYED benefits retroactively.&nbsp;<strong>\u201eApplication for childcare allowance\u201d<\/strong>&nbsp;form. However, you cannot claim benefits under point 3 of the form from 01.02.2023, as this is more than 6 months earlier. In this case, the earliest date for claiming is 01.04.2023 (first day of the 6th month preceding the claim).<\/em><\/li>\n<\/ol>\n\n\n\n<p>In the case of a retroactive claim, the mother is presumed to have received some benefit between the first day of the benefit claimed and the date of the claim.<br><em>(In example 1 above, the mother was receiving GYES benefits from 01.01.2023 to 28.03.2023, while in example 2 above, she was receiving GYED benefits from 01.04.2023 to 30.09.2023.)<\/em><br>In this case, the so-called&nbsp;<strong>\u201ebenefits paid without legal basis\u201d&nbsp;<\/strong>which the paying employer or the relevant government agency must order the mother to repay in writing within 90 days.&nbsp;<em>(Art. 66 of the Eb. tv.).<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A benefit is considered to have been paid without justification if the individual was not entitled to it or was entitled to it but not to the amount paid.<\/li>\n\n\n\n<li>If parents are entitled to benefits for their child at the same time&nbsp;<em>(sick pay, CSED, GYED, GYES, GYET),<\/em>&nbsp;at their choice&nbsp;<strong>only one parent can claim the benefit<\/strong>.&nbsp;<em>(The only exception to this rule is childcare allowance - GY\u00c1P.)<\/em><\/li>\n\n\n\n<li>In the present case, the mother was entitled to the benefit at the time of payment, but by claiming GYED, the father has to give up his claim and retroactively loses the right to the earlier payment.<\/li>\n<\/ul>\n\n\n\n<p>In such a case, the mother can repay in two ways:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Submitted by the father&nbsp;<strong><em>\u201eApplication for childcare allowance\u201d<\/em><\/strong>&nbsp;fill in the form&nbsp;<strong><em>point 8. your declaration of consent<\/em><\/strong>. Then the amount of GYED the father is entitled to will be deducted from the amount he has previously received without entitlement and only the difference will be paid.<\/li>\n\n\n\n<li>If the parents do not agree to the deduction with a \u201ejoint statement\u201d as described above, the benefit received without legal basis will be refunded, regardless of fault, to the&nbsp;<strong>the parent must repay<\/strong>, who took up the benefit.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In which cases might it be worth considering a claim for GYED by the father?<\/h3>\n\n\n\n<p>There are many reasons why parents might think about the father applying for GYED. The most common reasons are not exhaustive:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>The mother is not entitled to benefits, but the father is<\/strong><br>If the mother is not entitled to GYED because she is not insured or does not have the necessary insurance period to qualify, she can only receive the GYES benefit of HUF 28,500 gross.<br>In this case&nbsp;<strong>the father<\/strong>&nbsp;as soon as possible&nbsp;<strong>from the age of 169 days<\/strong>&nbsp;<strong>can claim GYED<\/strong>, the amount of which is more favourable than the amount of childcare allowance.<\/li>\n\n\n\n<li><strong>The father wants to stay at home with the child<\/strong><br>If the father wants to stay at home with the child and the mother wants to go back to work, the arrangements can be made as described above.<\/li>\n\n\n\n<li><strong>Financial consideration (the mother's income is very low or the father is entitled to a higher amount of GYED because of his higher income)<blockquote>The father is working before and after claiming GYED, or the mother would go back to work<\/blockquote><\/strong><blockquote><strong>The mother wants to stay at home, but because of her higher income, the father would take GYED<\/strong><blockquote><strong><\/strong><\/blockquote><\/blockquote><\/li>\n<\/ol>\n\n\n\n<p>At the end of the CSED period, the mother must notify her employer in writing that she wants to take unpaid leave until the child is three years old. The absence is not conditional on the mother applying for GYED or GYES during this period, so the employer cannot make it conditional.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What are the long-term, potentially negative aspects to consider before a father can claim GYED?<\/h3>\n\n\n\n<p>As much as the possibility of the father claiming a higher benefit may seem positive, it is important to consider the longer-term impact on the mother's insurance period, her future benefits and her pension.<br><strong>It is important that if the family is planning to have another child, careful consideration should be given to which parent will claim which benefits, when, especially in cases where the mother would give up her own GYED benefits as an insured person!<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Insurance period<\/h3>\n\n\n\n<p><strong>The father<\/strong>&nbsp;either staying at home with the child or working while caring for the child,&nbsp;<strong>provided<\/strong>&nbsp;remain.&nbsp;<strong>The mother<\/strong>&nbsp;but its potential needs to be considered in more detail:<br>A&nbsp;<strong>During the period when child benefit is paid<\/strong>, even if the mother is not insured for lack of gainful employment,&nbsp;<strong>entitled to health care<\/strong>, and the time of care is included in the&nbsp;<strong>qualifying period for a pension<\/strong>be is.<br>A&nbsp;<strong>while receiving GYED<\/strong>&nbsp;the mother&nbsp;<strong>provided<\/strong>, which means that this period can be taken into account for your additional benefits, entitles you to health care and counts towards your pension period.<br>If the mother is&nbsp;<strong>GYES\/GYED benefit waiver,<\/strong>&nbsp;or does not require it, and at the same time, if<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>returns to work<\/strong>, you will be insured in respect of your employment and gainful activity,<\/li>\n\n\n\n<li><strong>does not go to work<\/strong>, then the&nbsp;<strong>insurance will be discontinued<\/strong>, and&nbsp;<strong>not<\/strong>&nbsp;will be&nbsp;<strong>you are not entitled to health care<\/strong>.<blockquote>- For this reason, the mother<strong>&nbsp;obligation to pay health service contributions<\/strong>&nbsp;is generated.&nbsp;<em>(The amount of the health service contribution from 1 January 2023 is HUF 9,600.-, HUF 320.- per day).<\/em>&nbsp;This only entitles you to free medical and hospital care and does not count towards your pension.<\/blockquote><blockquote>&#8211; <strong>The previously insured mother entitled to GYED&nbsp;<\/strong>may face additional problems resulting from a break in insurance:<blockquote>- In the case of a second pregnancy, if you do not gain enough insurance time (i.e. you do not go back to work), you will not be able to claim sick pay if you are not insured.<\/blockquote><blockquote>- Your later eligibility for CSED and GYED will be called into question if you do not earn enough insurance (i.e. you do not go back to work).<\/blockquote><blockquote>- When you return to work, you will only be entitled to sick pay for the time you have worked\/leave since your return and the amount will be lower, as your continuous insurance period will be interrupted.<\/blockquote><\/blockquote><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">The amount of GYED<\/h3>\n\n\n\n<p>When considering the above, it is also worth bearing in mind that whatever the amount of the father's income, the&nbsp;<strong>GYED maximum<\/strong>&nbsp;the amount that may be assessed&nbsp;<strong>monthly<\/strong>&nbsp;up to the&nbsp;<strong>prevailing minimum wage<\/strong>&nbsp;<strong>twice 70 %-a<\/strong>&nbsp;<strong>can be found at<\/strong>. the ceiling for childcare allowance for 2023 is HUF 324,800 gross per month.<br><strong>In the case of multiple children, all care should be \u201eunder one roof\u201d<\/strong><br>As described above, benefits for children of different ages can be paid at the same time, i.e. a parent can claim CSED, GYED or GYES for children of different ages at the same time.&nbsp;<em>(Eb. tv.<\/em>&nbsp;<em>39. \u00a7)<\/em><br><strong>Important<\/strong>&nbsp;rule, however, that&nbsp;<strong>the same beneficiary can claim benefits for each child<\/strong>, which means that benefits are \u201econcentrated in one hand\u201d.&nbsp;<em>(Eb. tv.<\/em>&nbsp;<em>39. \u00a7 (5))<\/em><br>For example, if the father applies for GYED, but the new child is born, the mother cannot claim CSED because the father should claim CSED - but he is not eligible.<br>For this reason, if&nbsp;<strong>the mother is entitled to CSED for the younger child<\/strong>, The mother must claim the eligible GYED\/GYES benefit for the older child, and at the same time she has the possibility to claim CSED for the newborn child.<br>If, in the absence of eligibility criteria&nbsp;<strong>the mother is not entitled to CSED for the younger child<\/strong>, only GYES, then it must be examined whether the amount of paternal GYED is higher than if the mother received only GYES for both children. Then the following options can be considered:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The father cancels GYED and the mother claims GYES for both children.<\/li>\n\n\n\n<li>No benefit is claimed for the younger child until the little one is 168 days old, and the father claims GYED for the older child from day 169.<\/li>\n\n\n\n<li>As each child is entitled to benefits for as long as the legislation requires (e.g. GYED up to the age of 2), if the GYED for the older child expires in the first 168 days, the mother will be able to claim GYES for both children from the day after the expiry.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">GYED on-lending<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the parent who is currently claiming the benefit changes jobs, it is necessary to claim GYED in the new employment relationship, but not as a new benefit as described above, but the benefit once established is \u201etaken over\u201d by the new employer and paid at the same amount.<\/li>\n\n\n\n<li>You can request the continuation of GYED in writing, in&nbsp;<strong>\u201eApplication for the continuation of childcare allowance\u201d<\/strong>&nbsp;by completing and sending the form to the following address&nbsp;<strong>by contacting<\/strong>&nbsp;may require.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Moore Hungary<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>Moore Global, which started in a London office more than 110 years ago, is now one of the world's leading consulting and audit networks.
